The Government of Burkina Faso adopted a ‘National Action Planfor the Reform of the Judiciary (PANRJ). This sector policy document assesses the judiciary through a detailed analysis of the main problems, weaknesses and constraints in the sector and on the basis thereof proposes reform measures with as overall objective “to strengthen place of the judiciary within the State and within society in order to make it an essential actor of the democratic system and of the settling of private and public litigation.

Three specific objectives will contribute to the this global objective:

  • Strengthening the institutions that contribute to the functioning of the judiciary;
  • Improve access to the legal system;
  • Improve the effectiveness of the judiciary.These objectives are to be reached through the review of certain legal texts and their respect on the one hand and the strengthening of financial, material and human resources on the other hand.

The objective of this assignment is to support the Ministry of Justice in updating the current (financial and operational) implementation of the PANRJ on one hand and on the other hand to draft a reference document (plan for consolidating the PANRJ) which will allow the Ministry to develop a strategy and an action plan for the PANRJ for 2007-2009.

Type of services provided

PROMAN provided the services of a legal expert and an economist who focused on the following tasks:

As regards the assessment of the implementation of the PANRJ:

  • Examine the documents presented in frame of the national budget;
  • Examine the project implementation documents of investments financed by external aid;
  • Analyse the balances of the different contributions;
  • Assess the coherence of the current plan and the phasing of its implementation;
  • Analyse the results in terms of qualitative improvement, improvement of access and effectiveness.

As regards the draft of a plan for consolidating the PANRJ:

  • Assess the specific objectives and priorities;
  • Propose detailed programmes per objective;
  • Ensure coherence between programmes and the overall objective;
  • Define the necessary policies;
  • Draw up a budget;
  • Draw up a realistic investment plan;
  • Define an M&E system;
  • Define a logical framework and indicators.
